HJA Personal Injury Leaflet 2025

An example of the help we can provide As a child ‘A’ sustained a moderate to severe brain injury as a result of an accident that was not his fault. ‘A’ was a charming, personable individual and unlike someone who has for example, sustained recognisable broken bones, the true effects of his brain injury were not immediately apparent. Having sustained this ‘hidden’ injury, prior to contacting us he had been let down by his schools and the local authority who failed to appreciate or acknowledge the effects a brain injury can have on day-to-day life, education, community and ultimately the ability to hold down employment. Morale was rock bottom. Our specialist team listened to the issues. We were able to resolve liability and obtain interim payments to put in place a support package of rehabilitation with a case manager including: • Purchase of suitably adapted accommodation • Support workers to assist our client on a daily basis • Ongoing neuropsychological, occupational therapy and psychiatric input • Support for our client’s family to help them to better understand the brain injury and provide some respite when needed • Aids and equipment Our client was ultimately awarded a 7 figure sum. As he was vulnerable and open to abuse by others, we were able to bring in the expertise of our Court of Protection team who set up a Deputyship to assist our client manage his money and affairs. We have a specialist Court of Protection team who regularly deal with brain injured patients, the elderly with dementia and people with learning disabilities. They use their skills and expertise to manage the affairs of individuals lacking the capacity to make decisions for themselves and protect their interests.
